These Terms of Use govern access to and use of archconsults.com (the “Site”), operated by A.R.C.H. Consulting, LLC (“ARCH,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Informational purpose; no professional advice
Site content is provided for general informational and educational purposes. It is not legal, tax, accounting, investment, securities, cybersecurity, employment, medical, or valuation advice and does not replace advice from a qualified professional familiar with your circumstances. Examples, frameworks, articles, podcast material, and assessments do not guarantee any result.
No consulting relationship or offer
Using the Site, sending an inquiry, downloading material, subscribing to a newsletter, or scheduling an initial conversation does not by itself create a client, fiduciary, professional, employment, partnership, or agency relationship. A consulting engagement exists only under a separate written agreement signed by authorized parties. Service descriptions, availability, timing, and fees may change and are not an offer capable of acceptance through the Site.
Value My Business tool
The Value My Business tool is gated, unavailable for public use, and not approved to accept real business or financial information. No output from an inactive, staging, demonstration, or future assessment should be treated as an appraisal, fairness opinion, investment recommendation, tax position, financing commitment, or professional valuation. Do not attempt to bypass access controls or submit sensitive information to unavailable routes.
Acceptable use
You may use the Site only for lawful purposes. You may not:
- Interfere with Site operation, security, access controls, or other users.
- Probe, scan, scrape at a disruptive rate, introduce malicious code, or attempt unauthorized access.
- Submit false, unlawful, infringing, harassing, deceptive, or harmful material.
- Impersonate another person or misrepresent affiliation.
- Copy, republish, sell, or create derivative commercial products from Site content except as allowed by law or written permission.
- Use Site content, names, marks, or data to train or operate a commercial system in a way that infringes ARCH’s or another party’s rights.
Intellectual property
The Site and its original text, graphics, branding, logos, page designs, downloads, and other materials are owned by or licensed to ARCH and are protected by intellectual-property laws. A limited, revocable, nonexclusive license is granted to view the Site and make a reasonable number of copies for your own internal, noncommercial informational use, provided notices remain intact. No other rights are granted. Third-party names and marks belong to their respective owners.
User communications
You are responsible for information you send to us and for having the right to share it. Do not send trade secrets, privileged material, regulated records, or highly sensitive personal or financial information through general forms. Except where a separate written agreement says otherwise, an unsolicited message does not create a duty of confidentiality beyond obligations imposed by applicable law and our Privacy Policy.
Third-party links and services
The Site may link to or embed third-party websites and services. Links are provided for convenience or context and do not necessarily constitute endorsement. ARCH does not control and is not responsible for third-party content, availability, security, terms, or privacy practices.
Disclaimers
To the fullest extent permitted by law, the Site is provided “as is” and “as available.” ARCH disclaims warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, noninfringement, availability, and security. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
Limitation of liability
To the fullest extent permitted by law, ARCH and its owners, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity, arising from or related to Site use or inability to use the Site. Where liability cannot be excluded, it will be limited to the minimum amount permitted by applicable law. Some jurisdictions do not allow certain exclusions, so portions of this section may not apply.
Indemnity
To the extent permitted by law, you agree to indemnify and hold ARCH harmless from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful misuse of the Site, violation of these Terms, or infringement of another party’s rights.
Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Subject to any binding written agreement between you and ARCH, disputes concerning the Site will be brought in a court of competent jurisdiction serving the area where ARCH is located, unless applicable law requires otherwise.
Changes; severability; entire terms
We may update these Terms by posting a revised version with a new update date. Continued Site use after an update constitutes acceptance of the revised Terms. If a provision is found unenforceable, the remaining provisions continue in effect. These Terms and the Privacy Policy are the entire agreement governing general Site use and do not replace a separate signed services agreement.
